1. Who we are
Sunsugar Market (“Sunsugar Market,” “we,” “us”) is a Utah-based online farmers market. Buyers pre-order from local farms attending a market event; on market morning we collect the packed orders from each farm’s stall, stage them in coolers, and hand them off at a drive-through/walk-up pickup point during the stated window, or deliver them to homes in our delivery zone. By creating an account or placing an order you agree to these Terms and to our Privacy Policy.
2. We are a marketplace, not the seller
The farms on Sunsugar Market sell directly to you and are the sellers of record for their products. Farms set their own prices and keep 100% of them. We provide the platform and the fulfillment service (collection, cold-chain staging in insulated totes, pickup and delivery). Our revenue is the flat fulfillment fee you see as a line item at checkout — the fee from you is what makes $0 in fees for farmers possible.
3. Accounts
You must be at least 18 years old to create an account or place an order. Keep your account information accurate and your password private; you are responsible for activity under your account. We may suspend or close accounts that violate these Terms.
4. Ordering and payment
- Each market event has an order deadline. Orders can’t be placed after it — farms need time to pack, and the van leaves on schedule.
- Your cart can span multiple farms and is paid in one payment. Payments are processed by Stripe; your card details go to Stripe directly and never touch our servers.
- The fulfillment fee — currently $3 for pickup-point orders and $10 for home delivery — is charged per order and shown before you pay. Accounts with a waived fee tier pay $0, covered by the community fund.
- Items are reserved when you start checkout. If payment isn’t completed within about an hour, the order expires and the items are released to other buyers.
- An order is confirmed only when payment succeeds; you’ll get an email confirmation.
5. Pay-it-forward fund
At checkout you can add an optional contribution to the community fund, which covers fulfillment fees for neighbors who can’t afford them. Contributions are voluntary payments to Sunsugar Market, which administers the fund — they are not tax-deductible charitable donations. If your order is refunded in full, your contribution is refunded with it and reversed out of the fund.
6. Pickup and delivery
- Pickup ($3): come to the posted pickup point during the event’s pickup window. Bring the name on the order.
- Home delivery ($10): available to addresses in our Salt Lake City–area delivery zone (checked by ZIP code at checkout). Provide a complete, accurate address; if you won’t be home, delivery notes tell us where to leave the totes.
- Everything we hand off is fresh, perishable farm produce. Please collect it during the window and refrigerate promptly. If you miss your pickup window, email us at orders@sunsugarmarket.com — we’ll try to arrange an alternative, but we can’t guarantee perishables past market day.
7. Tote exchange
Orders are handed off in branded insulated totes with cold packs. Totes remain Sunsugar Market’s property and are loaned to you with your order: hand them back at your next pickup or delivery. Your account shows how many totes are out with you.
8. Cancellations and refunds
- You can cancel your whole order from your account any time before the farm packs it (while it shows as pending or paid). Paid orders are refunded in full — produce, fulfillment fee, and any pay-it-forward contribution.
- Farms can cancel an individual item before the market (a crop came up short, quality isn’t right). You’re refunded that item’s full price. The fulfillment fee is not refunded on a partial cancellation — the van run for the rest of your order still happens. If every item ends up cancelled, you’re refunded everything, fee included.
- Once the van has collected your order, cancellation is no longer self-serve — email orders@sunsugarmarket.com and we’ll make it right.
- Refunds go back to your original payment method through Stripe; your bank controls how quickly they appear (typically 5–10 business days).
9. Quality problems
Farms are responsible for the quality and safety of what they sell, and they stand behind it. If something in your order isn’t right, contact the farm through Messages or email us within 48 hours of handoff and we’ll arrange a refund or credit for the affected items.
10. Messages and community content
You can message farms directly and read their posts. Keep it civil and lawful: no harassment, spam, deceptive claims, or attempts to move Sunsugar Market orders off-platform to avoid the marketplace working as described. We may remove content or restrict accounts that abuse these features. There are no algorithms deciding what you see — feeds are reverse-chronological, and nothing on Sunsugar Market is AI-generated.
11. Disclaimers
We don’t grow, produce, or inspect the products sold by farms. Product descriptions, growing practices, and certification claims are the farms’. To the fullest extent permitted by law, the platform and fulfillment service are provided “as is,” and we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Farm products carry the risks inherent to fresh food; check listings for allergen and ingredient information and ask the farm when in doubt.
12. Limitation of liability
To the fullest extent permitted by law, Sunsugar Market’s total liability for any claim arising out of an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Changes to the service or these Terms
We may update the service and these Terms. For material changes we’ll post the updated Terms here and note the date above; continuing to use Sunsugar Market after a change takes effect means you accept it. Fees for future orders may change; the fee for an order you’ve already paid never changes retroactively.
14. Governing law and disputes
These Terms are governed by the laws of the State of Utah. Any dispute that we can’t resolve informally will be brought in the state or federal courts located in Salt Lake County, Utah. Please talk to us first — most problems are fixable with an email.
